II. The aim and subject matter of the Educomplex activities
14. The Educomplex activities are based on democracy and humanity, comprehensiveness, combination of national and universal values, person's free autonomous development and is based on the principles of secular character.
15. The Educomplex is responsible for the realization, development and choice of teaching methods of author (state alternative) educational programmes according to state educational standards, age physiological and socio-psychological features, dispositions and capabilities of the learners, meeting their life safety requirements.
The Educomplex implements the following business activities:
III. The Structure and Educational Activities of the Educomplex
16. The Educomplex is a union of experimental-research educational institutions (hereafter: branch) realizing pre-school, general public (including for the children with special needs and those having extraordinary capabilities), vocational, college career, preferred, further (including extracurricular) educational programmes.
The branch is not a legal entity; it doesn't have a separate balance and a bank account. The branch is authorized by the Educomplex to perform activities according to the activities of the Educomplex, its aims and objectives. The branch has an uncoded seal, form and an emblem.
The Educomplex branch activities are regulated by the legislation of RA, the Educomplex and branch regulations. The executive director of the Educomplex presents the branch regulations to the Educomplex Management Board for verification.
Taking into consideration the applications presented by the heads of the branches, the executive director of the Educomplex hands over buildings and other property to the branch disposal (use).
The head of the branch presents the branch development plan to the Educomplex Management Board for verification.
The Educomplex branches are the following:
Public educational institutions: Western School-garden of the Educomplex (previously: Basic School-kindrgarten in B4 Block), Eastern School-garden (previously: Basic School-kindergarten in B1 Block), Northern School-garden (previously: Art Specialized Public School), Southern School-garden (previously: Public School after Michael Ganyan), Middle School of Technological Education (previously: Vocational School), High School (Previously: Gymnasium)
Educational institution carrying out college career and vocational educational programmes: College (previously: Teacher Training College)
c) Educational institutions realizing further education: Art School, Musical School, Dance and Theatre School, Sports School, Chess School, Naturalists’ School, Environmentalist’s School, School in Nature.
17. The Management Board verifies organizational structure of the Educomplex presented by the director of the Educomplex. To solve the statutory goals and objectives the Educomplex creates educational centers, services, educational workshops, laboratories, clubs, study rooms, educational exchange center with lodgings, pedagogical center, library, centers of further education, and the Management Board verifies their work regulations presented by the director of the Educomplex.
18. The students of appropriate grades from the public schools of the Educomplex as well as from other schools can study in the Educomplex High School, Vocational School, and the schools of preference. The Educomplex Management Board can make a decision to have boarding conditions (hostel, guest home).
19. The kindergarten groups of the Educomplex public schools are a base for the Educomplex College students: the College students and their teachers do methodological research work designed by curriculum and work regulations; the students have their teaching practice there.
20. The facilities of the schools of preference of the Educomplex also fully serve the public school subjects designed by the curriculum.
21. The language of instruction in the Educomplex is literary Armenian. As prescribed by the Ministry, in the classes formed for national minorities, the instruction is done in their mother tongue with compulsory courses of Armenian.
22. The methodological-research, training activitiesare organized by the school subject chairs, professional groups (hereafter: profgroups).
23. The profgroups are managed by the leading teachers of the Educomplex. The heads of the profgroups and educational centers form the profgroup meeting. The Educomplex Management Board confirms the educational conception of the Educomplex presented by the meeting of profgroups. The profgroup meetings are managed by the deputy director of the Educomplex. The Educomplex Manegement Board verifies the list of the profgroups, the heads of the profgroups, the staff of the profgroup meetings and the work regulations of the profgroup meetings presented by the executive director of the Educomplex.
24. The students’ healthcare in the Educomplex is carried out by the medical service of the Educomplex and medical personnel attached by healthcare authorities, which is responsible for conducting joint preventive measures and maintenance of sanitary norms.
25. Educational work is organized on the base of the educational programme curriculum, the learner's individual curriculum, the Educomplex educational calendar, educational timetable and schedule.
26. The curriculum of the educational programme, the school subject syllabuses, the ways of organizing education, the assessment system are developed on the base of the educational state standards, the core curriculums and the standards of the educational programme.
27. The Educomplex Management Board verifies the curriculums of the branches, the subject syllabuses, the list of the text-books and methodological guides presented by the profgroup meetings.
28. Instruction is organized in groups and individually. The groups can be: class, groups of preferred activities, special course groups, preference development clubs, groups of educational trips, camp squads, visiting groups, and professional practice groups.
29. The number of learners in the groups is defined with the fixed figures in the outlay of costs of the Educomplex.
30. Group instruction is organized with lessons, club activities, educational projects, educational country studies trips, professional practice, educational camps, creative gatherings, concerts, exhibitions and performances providing.
31. According to the educational programme there are the following ways of instruction: full-time studies, distance, online, home-work ways giving the learner an opportunity to select a way of instruction which may be appropriate to the circumstances and conditions
32. Supplementary educational programmes including home-work are aimed at fulfillment of the learner’s educational order. Further educational programmes are implemented in the branches as an educational service in the work-shops, laboratories, clubs and classrooms.
33. In specific cases the regulatory deadlines of the learners’ acquisition of educational programmes may be amended in the manner prescribed by the Ministry.
IV. Management of the Educomplex
34. The Educomplex is managed by the Founder, Ministry, the Educomplex Management Board, (hereafter: Board), the Educomplex executive body, the executive director with his staff (hereafter: executive director).
35. To organize the educational work in the branches of the Educomplex effectively, boards of teachers are formed.
36. To cooperate with the community, parents effectively boards of parents are formed in the branches of the Educomplex. There can also be formed a Board of Trustees and other boards.
37. The boards can perform their activities also in a virtual environment.
38. The Founder of the Educomplex has the right to make a final decision on the activities and management of the Educomplex except in cases prescribed by law.
39. The exclusive powers of the Educomplex Founder are:
a) Founding the Educomplex
b) Subject matter and aims of the Educomplex activities including the prescription of the types of business activities.
c) Confirmation of transferring or attaching some state property to the ownership of the Educomplex.
d) Approval of the Educomplex Regulations and amendments in it.
e) Definition of the Educomplex management system
f) Reorganization and liquidation of the Educomplex
g) Appointing the liquidation commission of the Educomplex and approval of the liquidation balance
h) Resolving other issues under the legislation of RA and these Regulations.
The subpoints “c”, “d”, “e”, and “h are assigned to the Ministry by the Founder.
40. The Ministry carries out the general management of the Educomplex, ensures its normal activities, and takes responsibility for failing to do them or for doing them inadequately.
The Ministry:
a) as prescribed by these Regulations, implements the formation of school management bodies and early termination of their powers.
b) Supervises the activities of the Educomplex.
c) Suspends or revokes the Educomplex executive director’s directives, orders, instructions and decisions which contradict the legislation of the Republic of Armenia.
d) Hears reports on educational activity, examines the results of the activities.
e) Takes control of the use and maintenance of the state properties attached to the Educomplex.
f) Gives agreement by law, on the Founder’s decision or under these Regulations, to sell the property or lease it.
g) Carries out other functions by law, on the Founder’s decision or under these Regulations.
41. Executive director of the Educational Complex carries out the management of current activities in the Educomplex and takes responsibility for failure to comply with or inadequate performance of laws, other legal acts, the Founder’s or the Ministry’s orders, resolutions, these Regulations and signed contracts.
42. The Executive director:
a) without the power of attorney, on behalf of the Educomplex represents its interests and concludes deals.
b) takes part in the sessions of the Management Board with an advisory capacity.
c) manages the Educomplex property and financial resources as prescribed by the legislation of the Republic of Armenia, resolutions of the Founder and the Ministry and these Regulations.
d) gives the power of attorney to act on behalf of the Educomplex, including with re-authorizational power.
e) appoints or dismisses the employees of the Educomplex, applies incentives and disciplinary punishment to them.
f) opens bank accounts in the banks.
g) does work distribution among his deputies, staff and branch directors, presents his staff structure and work regulations to the Management Board for approval.
h) by law, under these regulations and within the boundaries of his powers gives orders, commands, instructions for compulsery performance monitors their performance.
i) in the prescribed manner, implements the right selection of pedagogical personnel and creates necessary conditions for their professional development.
j) takes control of the contents of teaching, the quality of the learners' knowledge acquisition, their behaviour, extracurricular work, the performance of job dudies by the personnel of the Educomplex.
ja) provides internal discipline rules, observance of labor protection and safety engineering. jb) supports the work of boards of teachers and parents.
jc) forms the Educomplex staffing table and calculations on costs and after havin them approved by the Management Board presents to the Ministry.
jd) implements other powers, non-delegated to other educational bodies of the Educomplex, and which do not contradict the legislation of RA.
je) organizes the performance of the resolutions made by the Management Board.
jf) represents the Educomplex in the state bodies, in the Armenian and foreign educational institutions, enterprises and organizations. Except for pedagogical, scientific and creative jobs the director can't take any other position or do any other paid jobs.
43. In the absence of the executive director his powers are performed by another person.
44. The Ministry, within 30 days after the registration of the Educomplex Regulations, forms the new composition of the Educomplex Management Board (15 members). Prior to the formation of the Board's new composition, the functions of the Board are implemented by the current Management Board of the Educomplex.
Candidates for Board members are nominated by:
1) the Educomplex staff assembly, which with a ballot elects the pedagogical employees of the Board (4 members).
2) the parent boards of the branches, which with a ballot elect their members of the Board (2 members from school-gardens, one member from the Middle School and one member from the High School).
3) The learners’ assemblies of the College and High School nominate their candidates (2 members from each).
The Ministry appoints its representatives (3 members).
Only physical persons can be nominated for the Educomplex Management Board.
The director of the Educomplex can't be nominated (elected) member of the Board.
45. The term of office of the Board is 3 years.
46. The first session of the Educomplex Management Board is held at the request of the Ministry within 7 days after the approval of the nominal composition of the Board. Board Council of the Ministry's request within 7 days after the approval of of the Board. At the first session, the chairman of the Board is elected by a secret ballot and by a simple majority of the total number of the Board members for the whole term of office. The powers of the chairman may be terminated in accordance with chairman's application.
47. The Board member is removed from office:
a) on the nominator’s initiative and the decision of the Board,
b) in accordance with his/her application.
In case of termination of office of a Board member, his/her nominating body presents a new member within 20 days.
48. The Board:
a) selects an executive director of the Educomplex according to the contest regulations set by the Ministry, signs the labour contract with him/her, determines the director’s remuneration order.
b) confirms the deputies executive director presented by the executive director, signs the labour contract with the brach director, determines the branch director's remuneration order.
c) takes a decision on conducting the audit of the Educomplex (at the expense of the Educomplex budget) and approves of auditor's remuneration.
d) approves the organizational structure of the Educomplex, employment and internal disciplinary rules, the Educomlex's annual budget and the list of posts, reports on financial-economical and educational activities and makes a proposal to the Ministrythe financial statements and the proposal of the Ministry and educational activities.
e) considers the application for funding the budget of the next financial year, decides the main directions and order of disposing the profit as prescribed by the Founder, presents proposals to the Founder to make amendments in the Regulations.
f) confirms the rules of procedure, elects chairman of the Board.
g) in accordance with the subject matter, goals and objectives of the Educomplex, presents recommendations to the Ministry, confirms the the Educomplex educational programmes, the research and methodological themes presented by the profgroup meeting.
h) in the manner prescribed, confirms the annual cost estimate of the branches, and presents the Educomplex staff list to the Ministry, considers annual financial and educational research activity reorts.
i) implements powers entrusted by the Founder and designed by these Regulations and the Regulations of the branches.
49. Changing the Ministry (its management) or changing the Jurisdiction of the Educomplex, can not be a basis for termination of the powers of the board.
50. The chairman of the Board:
a) organizes the Board work,
b) chairs the sessions of the Board,
c) organizes the Board protocols and ratifies them.
51. In the absence of the chairman of the Board, on its decision the chairman’s duties are done by one of the Board members.
52. The Board sessions are convened by its chairman at least once every three months, as well as by the Ministry, the executive director or at the request of the 1/3 of the Board members. The session, at the request of the 1/3 of the Board members, is convened with the date and agenda prescribed by the initiators.
53. The session of the Board shall be valid if attended by more than half of the Board members.
54. The decisions of the Board are adopted by the majority of votes of the members present. During voting the Board member has only one vote. Vote transfer and transfer of the right to vote to another member are not allowed. The sessions of the Board are recorded and published on the Board website, on mskh.am. The powers of the Board member are suspended in case he/she participates in the contest for the director’s post.
55. The Ministry, the director of the Educomplex, directors of the branches, their deputies, and the Board members should act reasonably and in good faith while speaking out on behalf of the Educomplex, in the interests of the Educomplex (branch) being presented by them.
56. The supervision of the Educomplex activities is carried out by the Founder, the Ministry, other state bodies authorized by the founder and stipulated by law.
V. The Ownership of the Educomplex, the Property Attached to it and Financial - Economic Activities
57. The ownership of the Educomplex is formed at the time of its foundation, and later with the property handed over by the Founder with the ownership right and the property produced and acquired during the Educomplex activity.
58. The Educomplex has the right to freely own and use the property belonging to it by ownership right in accordance with law, the Founder's decisions or its Regulations.
59. The Founder has no ownership rights over the property belonging to the Educomplex with the exception of property left after the liquidation of the Educomplex.
60. The Educomplex bears the burden of maintaining property.
61. The property of the Educomplex can be confiscated only by court order.
62. The Founder has the right to reclaim the property attached by it to the Educomplex.
63. The Educomplex has no right to dispose, mortgage, transfer of free use the property attached to it or the ownership right. The Educomplex has the right to lease the property attached to it on behalf of the state as prescribed by law.
The lease time frame of the attached property can't be fixed more than a year except in cases established by the Founder.
The income got in the result of the use of the attached property is the ownership of the Educomplex.
The integral improvements generated during the use of the attached property are the ownership of the Founder.
64. The Educomplex manages its financial resources by legislation of the Republic of Armenia.
65. The educomplex is funded by the Founder. The financial resources of the Educomplex come from budgetary and extra budgetary sources not prohibited by the legislation of the Republic of Armenia.
66. The additional financial sources of funding the Educomplex are:
a) the funds got from the paid educational services as prescribed by order of the Government of the Republic of Armenia.
b) charities, targeted investments of the organizations and citizen’s donations of the Republic of Armenia and foreign countries.
c) the funds received from activities not prohibited by the legislation of the Republic of Armenia and not contradicting the Regulations of the Educomplex.
67. The authenticity of the annual financial reports of the Educomplex may be subject to audit (checkup) by the auditor selected by the Ministry or by a body of the Government of the Republic of Armenia implementing financial functions.
VI. The Educator of the Educomplex, the Learner and the ParentModules (Extend site functionality.)
68. A specialist, who meets the requirements of the job descriptions identified for the pedagogical employee of the Educomplex, can be admitted to the position through the public selection procedure as decided by the order of the Board.
69. The Educomplex educators' and other employees' rights and obligations are defined in accordance with the legislation of the Republic of Armenia, Rules, the job descriptions of the employees, employment contracts.
70. The student's and parent's rights and duties of the Educomplex branch are defined by law, rules, and the educational contract.
71. The student of the Educomplex branch takes responsibility for the performance of his/her duties in accordance with the Rules and the educational contract.
72. The branch may unilaterally terminate the educational contract in case of the student’s or the parent’s failure to fulfill the provisions of the educational contract signed by the branch and the parent, informing the parent about it ten days before.
VII. Reorganization and Liquidation of the Educomplex
The Educomplex is reorganized and liquidated in accordance with the legislation of the Republic of Armenia.
The amendments in the Regulations have been done according to the decree of the Ministry of ES of RA N533, 15.05.2017
